​§ 1 General, Scope (1) The following Terms and Conditions (hereinafter referred to as “T&Cs”) apply to the provision of brokerage and advisory services between us, Dubai Capital Investments, Bay Square, Building 12, Floor P, P-02, Office 27, Business Bay, Dubai, Phone: +49 176 81447281, Email: info@dubai-capitalinvestments.com (hereinafter referred to as the “Contractor”), and our clients (hereinafter referred to as the “Client”; jointly referred to as the “Parties”). (2) These T&Cs apply to both consumers and business clients unless otherwise specified. (3) These T&Cs apply exclusively. Conflicting or additional terms shall not apply unless expressly agreed in writing. (4) The Contractor operates in an international context, particularly in connection with real estate investments in foreign markets. (5) Information regarding the collection and processing of personal data can be found in our Privacy Policy, which forms an integral part of these T&Cs. § 2 Subject of the Contract (1) The subject of this agreement is the provision of brokerage and advisory services related to real estate investments. (2) The Contractor supports the Client in identifying suitable investment opportunities and facilitating the conclusion of contracts. (3) The Contractor may provide additional support services, including but not limited to: • coordination of payment processes • assistance with bank account setup • guidance regarding residency or visa-related processes (4) These services are provided as support only and do not constitute legal, tax, or financial advice. (5) The Contractor does not guarantee the successful conclusion of a contract or specific investment outcomes. § 3 Conclusion of Contract (1) The Client may submit a non-binding inquiry via phone, email, or online form. (2) The Contractor may respond via phone, email, or other communication channels. (3) A contract is concluded upon explicit agreement or upon acceptance of a provided offer or exposé. (4) The Client is responsible for providing accurate contact details. § 4 Right of Withdrawal Consumers have a statutory right of withdrawal of fourteen (14) days. Further details are provided in the withdrawal policy below. § 5 Rights and Obligations of the Contractor • The Contractor may act for multiple parties where permitted and disclosed • The Contractor acts with professional diligence • The Client will be informed about relevant developments • Confidentiality will be maintained § 6 Rights and Obligations of the Client • The Client must provide all relevant information truthfully • The Client supports the process and communication • The Client agrees to treat all received information confidentially • The Client must inform the Contractor about any concluded transactions § 7 Commission and Payment Terms (1) The Contractor does not charge any upfront fees for consultation or initial advisory services unless explicitly agreed otherwise. (2) Commissions for transactions are agreed individually and depend on the respective investment and transaction structure. (3) The commission becomes due upon successful conclusion of a contract, unless agreed otherwise. (4) Payments may be processed via bank transfer or alternative methods (e.g. cryptocurrency), subject to individual agreement and applicable regulations. (5) The commission remains valid regardless of later changes to the transaction. § 8 Set-Off and Retention Rights • Set-off rights are limited to legally established claims • Retention rights are limited to contractual claims § 9 Anti-Money Laundering • The Contractor may be required to verify the identity of the Client • Relevant documents may be retained in accordance with applicable regulations § 10 Term and Termination • Contract duration may be agreed individually • Either party may terminate the agreement with reasonable notice • Immediate termination is possible for valid cause § 11 Liability (1) The Contractor shall be liable without limitation for intent and gross negligence. (2) For minor negligence, liability is limited to foreseeable damages. (3) The Contractor shall not be liable for: • investment performance • market developments • expected returns § 12 Dispute Resolution (1) The Contractor is not obligated to participate in dispute resolution proceedings before a consumer arbitration board. § 13 Final Provisions (1) Applicable law and jurisdiction depend on the specific contractual agreement between the Parties. (2) Should any provision be invalid, the remaining provisions remain unaffected. Withdrawal Policy Right of Withdrawal You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period is fourteen days from the date of contract conclusion. Early Expiry of Withdrawal Right The right of withdrawal expires once the service has been fully performed, provided that the Client has expressly agreed to this.
